These Terms of Use (“Terms”) govern your access to and use of ExamGiant’s websites, games, competitions, and related services (the “Services”). By creating an account, accessing, or using the Services, you agree to these Terms.

These Terms are a general template and do not replace legal advice. We encourage schools, districts, and organizations to have their own counsel review and, if needed, customize these Terms for their use.

1. Who May Use ExamGiant

• Adults (18+) may create accounts for themselves or for children under their care (for example, parents, guardians, teachers, and school/district staff).
• Students under the age of 18 should only use ExamGiant with the permission and supervision of a parent, guardian, teacher, or school.
• By creating an account, you represent that you are old enough to do so under the laws of your region, or that you are doing so on behalf of a minor for whom you have legal authority.

2. Accounts and Security

• You are responsible for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• You agree to notify us promptly if you believe your account has been compromised.
• We reserve the right to suspend or terminate accounts that appear to be misused, fraudulent, or harmful to other users.

3. Roles: Students, Parents, Teachers, and Schools

During registration, users identify themselves as students, parents/guardians, teachers, school or district administrators, or homeschool coordinators.

• “Power” roles (teacher, school admin, district admin, homeschool admin) may be subject to additional verification before school-wide tools are enabled.
• We may request additional information, such as a school website or staff-directory link, to verify educator or administrator status.
• Misrepresenting your role (for example, a student pretending to be a teacher) may result in account restrictions or removal from competitions.

4. Acceptable Use

You agree not to:

• Use the Services for any illegal, harmful, or fraudulent purpose.
• Harass, threaten, or harm other users.
• Attempt to cheat or manipulate competitions or leaderboards.
• Reverse engineer, interfere with, or disrupt the security or operation of the Services.
• Upload malicious code or attempt to gain unauthorized access to our systems.
• Use automated bots or scripts to play games or submit scores, unless explicitly allowed.

5. Educational Content and Competitions

• ExamGiant provides practice problems, games, and competitions intended to support learning, but we do not guarantee any particular test scores, grades, or admissions outcomes.
• Competition rules, eligibility, scoring, prizes, and deadlines may be posted separately for each event. Those specific rules are incorporated into these Terms by reference.
• We reserve the right to disqualify participants or adjust scores if we detect cheating, abuse, or technical problems.

6. Intellectual Property

• The Exams, questions, games, software, graphics, logos, and other content on ExamGiant are owned by ExamGiant or its licensors and are protected by copyright and other laws.
• You may use the Services and content only for personal, classroom, homeschool, or school-approved educational purposes.
• You may not copy, resell, or redistribute substantial portions of our content without written permission.

7. Privacy

Our Privacy Policy explains how we collect, use, and share personal information. By using the Services, you also agree to the Privacy Policy.

8. Disclaimers

• The Services are provided “as is” and “as available.”
• We make reasonable efforts to keep the platform up and running, but we do not guarantee uninterrupted or error-free operation.
• We do not guarantee that every question, explanation, or result is free from error, though we work hard to correct issues when they are reported.

9. Limitation of Liability

To the maximum extent permitted by law, ExamGiant and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Services.

In no event will our total liability for any claim related to the Services exceed the amount you paid (if any) for the portion of the Services giving rise to the claim in the previous twelve (12) months.

10. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or are using the Services in a way that could harm others or the platform. You may stop using the Services and request account closure at any time by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top will show when changes were made. Continued use of the Services after changes become effective means you agree to the revised Terms.

12. Governing Law

These Terms are governed by the laws of the U.S. state of Kentucky and applicable U.S. federal law, without regard to conflict-of-law principles. Some users, such as schools in other countries, may have additional rights under their local laws.
